Below you will find a link to the Receiver’s letter to investors explaining the claim procedure. Investors should receive a copy of this letter by mail within the next week.

Investor Proof of Claim Declaration Form
Below you will find a link to the Receiver’s Investor Proof of Claim Declaration Form including instructions. Investors should have received copies of the Investor Notice Letter and the Investor Proof of Claim Declaration Form by mail. Please read the form and its instructions carefully, complete the form as instructed, and return the signed original to the Receiver by mail. The Investor Proof of Claim Form may not be submitted by email, rather the signed original must be submitted to the Receiver via US Mail.
The Court set a “Bar Date” of April 27, 2007. Please understand that in order to be able to share in distributions from the Receivership Estate, your completed proof of claim declaration form must be received in my office (at the address indicated on the form) on or before April 27, 2007.

As referenced above, the Receiver has sent out an official notice to all investors for whom he has contact information giving formal notice of the receivership and asking that they file proofs of claim, showing the amount of cash investments they made in the receivership companies, minus any cash that they received back, whether regarded at the time as payment or withdrawal of “earnings” or as return of principal. With the notice investors will receive a form with instructions explaining how to submit their proof of claim and giving a deadline or “bar date” within which to submit the proof of claim. All proofs of claim will need to be submitted under oath, notarized, and supported by copies of checks, wire transfer records and other documents establishing the investment amount. All investors will be treated as creditors of the receivership estate.
At this time the Receiver is requesting that all investors who have not yet provided the Receiver with the following contact information do so via email at WestonRutledgeReceiver@pogolaw.com:
- Full Name;
- Mailing Address;
- Telephone number at which you wish to be contacted;
- Email address at which you wish to be contacted;
- Account numbers for investments with Lexington International, Oxford Adams, or Zamindari.
Furthermore, make certain that you are preserving all records of your investments and claims.

With the notice creditors will receive a form with instructions explaining how to submit their proof of claim and giving a deadline or “bar date” within which to submit the proof of claim. All proofs of claim will need to be submitted under oath, notarized, and supported by copies of checks, wire transfer records and other documents establishing the claim amount.

NOTICE REGARDING BAR DATE DEADLINE:
The Court has set a Bar Date for the submission of investor or creditor claims. The Bar Date for submitting investor and creditor claims is APRIL 27, 2007.
A copy of the Court’s Order setting the Bar Date is available on the Court Filings portion of this Web site.
Please understand that in order to be able to share in distributions from the Receivership Estate, your completed proof of claim declaration form must be received in my office (at the address indicated on the form) on or before April 27, 2007.
The bar date is merely a deadline to file claims and in no way indicates an end of the receivership or an end of the litigation.
